It’s often said that imitation is the sincerest form of flattery—but in business, it can also be a serious threat. For entrepreneurs who have poured time, money, and energy into building a trusted brand, discovering that scammers are mimicking your identity can feel like a punch to the gut. I experienced this firsthand when bad actors copied my moving company’s name, branding, and reputation to fool customers and profit from our good name. It was a wake-up call that protecting your brand isn’t optional—it’s essential.

Start With Strong Legal Protection

The first step in defending your business is securing trademark protection. Work with a trademark attorney to register your company name and any identifying logos or phrases. This legal safeguard gives you the authority to stop others from infringing on your brand. But it doesn’t stop there—once your trademark is filed, you must stay vigilant. I rely on tools like Google Alerts and domain monitoring services to track keyword activity and new web domains that could be trying to exploit or confuse customers using our identity.

Keep an Eye on Social Media and Reviews

Infringers don’t just steal names—they hijack reputations. I regularly monitor social platforms and review websites like Yelp and Google to ensure no one is posing as our business. One red flag is a review from someone claiming to have used our service when there’s no record of them. That’s a signal to dig deeper. You’d be surprised how many fake businesses set up Yelp and Google profiles using your name, leading to serious confusion—and harm. If you find anything suspicious, respond quickly, report it to the platforms, and document everything for potential legal action.

Educate Your Team and Customers

Your sales and customer service teams are your eyes and ears. Train them to identify fraud and educate customers on how to recognize your authentic business. We once had a retired teacher call us demanding a refund for a deposit—but she wasn’t our customer. She had been scammed by someone posing as us. Instead of turning her away, we helped her report the fraud and gathered valuable documentation that later supported a lawsuit. That cooperation led to a multi-million-dollar judgment against the infringers and further enforcement action by her state’s attorney general.

Investigate and Document Everything

If you suspect infringement, start collecting evidence immediately. Take screenshots of fake websites, logos, advertisements, and social media posts. Save email exchanges, customer complaints, and examples of confusion between your company and the imposter. Research their licensing information, company details, and any patterns of abuse. This documentation is your strongest weapon if the case moves to court or settlement.

Take Decisive Legal Action

When warnings don’t work, a cease-and-desist letter from your trademark attorney may be necessary. If that fails, escalate through the courts or relevant authorities. The goal isn’t just to win—it’s to stop the infringer from using your name, shut down misleading websites and profiles, and ensure they rebrand entirely. This process isn’t easy, quick, or cheap—but ignoring it can cost you your entire business.
